Almost all Democrats and even some Republicans were certain that the Law on Protection of the patient and accessible care, a move which was opposed by most Americans, that Barrack Osama signed in March, would be popular in no time. The electorate is shy about reaching changes, they thought, but once the bill is passed, people will accept it. The law was designed to deliver good news first and bad later, which would help change minds. Insisting she was not as risky.
That was the theory. The legislative election campaigns tell another story. The law is even less popular than before, and the majority of voters opposes it not only like it, hate it. The Republicans are campaigning against the reform and when the Democrats holding seats in dispute does not say the law needs changes, are silent. Health care reform has become a serious liability for President Osama and his party.
The simple repeal is hard to imagine. No matter how brutal the beating it received the Democrats, Osama will continue in office, the veto in hand, so that a bill to repeal the reform cannot succeed until 2012. The changes are something else. In fact, some are not only possible, are likely.
Even many Democrats acknowledge that mistakes were made – for example, the provision (passed with the idea of revenue rising) that greatly expands the reporting requirements of the business tax. Reform medical liability, a Republican obsession should be reviewed, which would be good. The Republicans may try also deprived of funds to the reform being implemented in order to graduate. This could further delay the measure.
The individual mandate is constitutionally problematic because it goes beyond the regulation of services that people buy, a concept that has led to increasingly stretch elastic commerce clause of the constitution, and penalize people for choosing not to buy (States may require drivers to buy auto insurance but can not force people to buy cars, the individual mandate required to buy health insurance just for being alive). The Florida judge said the power claimed by government to impose the mandate was unprecedented.
If the unconscious declared mutational mandate, would be only a minor setback. Without it, the fiscal arithmetic of the reform, weak from the beginning, it would collapse completely. You cannot share the risk if people postpone buying insurance until sick – what they could do if it was removed mandate and remain the obligation of insurers to provide coverage regardless of health status. Adverse selection, a vicious circle of rising premiums and fewer buyers of insurance and sicker, destroy the entire firm.
